THAT HE/SHE IS OWNER OF THE PHOTOGRAPH (OR HAS PERMISSION); THAT IT IS NOT A COUNTERFEIT OR STOLEN ITEM; THAT IT DOES NOT INFRINGE ANY THIRD PARTY'S COPYRIGHT, LICENSE, PATENT, TRADEMARK, TRADE SECRET OR ANY OTHER PROPRIETARY RIGHTS OR RIGHTS OF PRIVACY; THAT THE PHOTO DOES NOT VIOLATE ANY LAW, STATUTE, ORDINANCE OR REGULATION (INCLUDING WITHOUT LIMITATION THOSE GOVERNING IMPORT/EXPORT CONTROL, CONSUMER PROTECTION, UNFAIR COMPETITION, ANTI-DISCRIMINATION OR FALSE ADVERTISING); THAT THE PHOTO WILL NOT BE OBSCENE OR CONTAIN CHILD PORNOGRAPHY; AND THAT THE PHOTO SHALL NOT CREATE LIABILITY FOR PHOTOTHROWSTORE AND OCCASION ESSENTIALS. CUSTOMER AGREES TO INDEMNIFY AND HOLD PHOTOTHROWSTORE AND OCCASION ESSENTIALS, ITS SUBSIDIARIES, AFFILIATES, OFFICERS, DIRECTORS, AGENTS AND EMPLOYEES, HARMLESS FROM ANY CLAIM OR DEMAND, INCLUDING BUT NOT LIMITED TO REASONABLE ATTORNEY'S FEES, MADE BY ANY THIRD PARTY DUE TO OR ARISING OUT OF CUSTOMER'S BREACH OF THIS AGREEMENT AND/OR CUSTOMER'S VIOLATION OF ANY LAW OR THE RIGHTS OF ANY THIRD PARTY. WE RESERVE THE RIGHT TO REFUSE TO PROCESS ANY ORDER WE DEEM TO BE OFFENSIVE IN ANY MANNER.
